Terms of Service

Please read these terms carefully. By accessing or using TroponinIQ, you agree to be bound by these Terms of Service. These Terms include a binding arbitration clause and class action waiver in Section 15, which affect your legal rights. If you do not agree to all of these Terms, do not use the Platform.

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and JJH Enterprises, LLC, doing business as TroponinIQ ("Company," "we," "us," or "our"). These Terms govern your access to and use of the TroponinIQ platform, website (troponiniq.com), AI coaching services, and all related content and functionality (collectively, the "Platform").

By creating an account, subscribing to a plan, or otherwise using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.

2. Eligibility

You must be at least 18 years of age to use the Platform. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Medical Disclaimer

TroponinIQ is not a medical provider and does not provide medical advice.

All content, coaching, recommendations, and information provided through the Platform - whether generated by our AI system or by human coaches - is for educational and informational purposes only. Nothing on the Platform should be interpreted as medical advice, diagnosis, or treatment.

Specifically, you acknowledge and agree that:

• The AI coaching system and human coaches are not licensed medical professionals acting in a medical capacity.
• Blood work analysis provided through the Platform is educational and does not replace analysis by your physician.
• Nutrition, training, and supplementation recommendations are general guidance and may not fit your condition.
• You should consult a qualified healthcare provider before making changes to diet, exercise, or supplementation.
• If you experience a medical emergency, call 911 or local emergency services immediately.
• You use the Platform and follow recommendations at your own risk and discretion.

4. No Guarantee of Results

TroponinIQ does not guarantee any specific results from using the Platform. Results from bodybuilding, nutrition, competition prep, or any fitness program vary based on individual factors including genetics, effort, consistency, adherence, pre-existing conditions, and variables beyond our control.

Testimonials, case studies, or examples shown on the Platform are individual experiences and are not guarantees that you will achieve the same or similar results.

5. Account Registration and Security

To access the Platform, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information.
• Keep your password secure and confidential.
• Notify us immediately of any unauthorized access to your account.
• Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate your account if we suspect unauthorized use or violation of these Terms.

6. Subscription Plans and Payment

6.1 Plans and Pricing

TroponinIQ offers multiple subscription tiers, including but not limited to:

• Base tier (approximately $20/month) - AI coaching access.
• Mid-tier plans (approximately $50-$100/month) - enhanced AI coaching with additional features.
• Premium tier (approximately $199/month) - includes human coaching from Justin Harris.

Prices, features, and availability are subject to change. Current pricing is always displayed on the Platform. Changes to pricing apply upon renewal.

6.2 Billing and Payment

All payments are processed through Stripe. By subscribing, you authorize us to charge your selected payment method on a recurring basis at the applicable subscription rate. Subscriptions automatically renew unless canceled before renewal.

6.3 Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Upon cancellation, access continues through the end of your current billing period. We do not provide pro-rated refunds for partial billing periods. Refunds are issued at our sole discretion and only in exceptional circumstances.

7. Acceptable Use

You agree not to:

• Use the Platform for unlawful purposes or in violation of applicable laws.
• Share account credentials or allow others to access your account.
• Attempt to reverse engineer, decompile, or extract source code.
• Use bots, scrapers, or automated tools without written permission.
• Interfere with Platform security, integrity, or performance.
• Reproduce, redistribute, or commercially exploit Platform content without authorization.
• Harass, threaten, or abuse other users or staff.
• Submit false, misleading, or fraudulent information.
• Attempt to extract or reproduce proprietary AI coaching methodology, prompts, or algorithms.

8. Intellectual Property

8.1 Our Intellectual Property

All content, features, and functionality of the Platform are owned by JJH Enterprises, LLC and are protected by applicable intellectual property laws.

8.2 Your Content

You retain ownership of content you submit to the Platform ("User Content"). By submitting User Content, you grant JJH Enterprises, LLC a non-exclusive, worldwide, royalty-free license to use, process, and store your User Content solely to provide and improve Platform services.

We may use anonymized, aggregated data derived from User Content for Platform improvement, research, and development. This aggregated data will not identify you.

8.3 Feedback

Suggestions, feedback, or ideas you provide about the Platform become the property of JJH Enterprises, LLC, and may be used without compensation.

9. AI-Generated Content

The Platform uses AI to generate coaching recommendations, nutritional guidance, blood work analysis commentary, and other content. You acknowledge that:

• AI-generated content may contain errors, inaccuracies, or omissions.
• AI-generated content should not be the sole basis for health, fitness, or nutritional decisions.
• The Company is not liable for actions you take based on AI-generated content.
• AI technology is continuously evolving and output quality may vary.

10. Third-Party Services

The Platform integrates with third-party services including Stripe, Shopify, Google Analytics, Facebook Pixel, and ElevenLabs. Your use of third-party services is subject to their terms and privacy policies.

11. Limitation of Liability

To the maximum extent permitted by applicable law, JJH Enterprises, LLC, its owner, employees, agents, and affiliates shall not be liable for indirect, incidental, special, consequential, or punitive damages.

In no event shall our total liability to you for all claims exceed the amount you have paid to us in the twelve (12) months preceding the claim.

12. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind.

We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

13. Indemnification

You agree to indemnify, defend, and hold harmless JJH Enterprises, LLC and related parties from and against claims, liabilities, damages, losses, costs, and expenses arising out of or related to your use of the Platform or violation of these Terms.

14. Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to conflict of law principles.

15. Dispute Resolution and Arbitration

15.1 Informal Resolution

Before filing a formal dispute, you agree to contact us at support@troponiniq.com and attempt informal resolution for at least 30 days.

15.2 Binding Arbitration

If unresolved informally, disputes will be resolved by final and binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules.

15.3 Class Action Waiver

Each party may bring claims only in an individual capacity and not as a plaintiff or class member in any class, consolidated, or representative proceeding.

15.4 Exceptions

Either party may bring an individual action in small claims court within that court's jurisdiction and may seek equitable relief to protect intellectual property.

16. Termination

We may suspend or terminate your account and access to the Platform at any time, with or without notice, for any reason, including violation of these Terms.

Upon termination:

• Your right to use the Platform ceases immediately.
• You may request a copy of your data within 30 days of termination.
• We will delete your personal data per our Privacy Policy and retention schedule.
• Sections 3, 4, 8, 11, 12, 13, 14, 15, and 17 survive termination.

17. General Provisions

Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and JJH Enterprises, LLC regarding the Platform.

Severability: If any provision is unenforceable, the remaining provisions continue in full force and effect.

Waiver: Failure to enforce any right or provision is not a waiver of that right or provision.

Assignment: You may not assign rights without prior written consent. We may assign our rights and obligations without restriction.

Force Majeure: We are not liable for failure or delay due to events beyond reasonable control.

Notices: We may provide notices via email or Platform posting. You may send notices to support@troponiniq.com.

18. Changes to These Terms

We reserve the right to modify these Terms at any time. For material changes, we will provide notice by email or prominent Platform notice at least 30 days before changes take effect.

If you do not agree to revised Terms, you must stop using the Platform and cancel your subscription before changes take effect.
